More than 4,000 people are facing a distressing, government-imposed uncertainty: They might be sent back to prison, with no idea of when it could happen.
Miranda McLaurin is just one of those individuals. She is a disabled Army veteran sentenced to five years for a drug offense – but was recently allowed to serve her sentence at home under the CARES Act, which passed in response to COVID-19 to prevent the spread of the virus.
Now, she could be sent back to federal prison more than 1,000 miles away. Why?
It's all happening because of one memo the Trump administration issued just as he left office. But President Biden can end it by using his clemency authority to commute these individuals' sentences – and you can tell him to do so now. <[link removed]>

ACLU Supporter, forcing so many people back to prison in this way is cruel, legally unnecessary, ineffective at making us safer, and costly.
Everyone released to home confinement under the CARES Act was already determined not to be a risk and had to meet strict criteria from Trump's Justice Department. It was part of the condition of release. There's also nothing in the law's text that states people released must be sent back to prison once COVID is no longer a threat. And people like Miranda were not even told that there was the chance they'd have to return after being released. That's why Miranda and thousands of people like her have started planning their futures, gotten jobs, signed leases, and reintegrated with their families and communities.
For months, the ACLU and our partners have called on President Biden to prevent this impending crisis – and I know with enough pressure from activists like you joining our efforts now, we can make it happen.
