Dear Friend,
As we celebrate July 4th, we can all recognize that our nation’s commitment to the rule of law has just weathered--and still faces--attacks of a kind we have never seen before. During the last Supreme Court term, we defended our democracy, equality, and health care. The results were mixed, underscoring that we have some work to do.

The attacks on our democracy, both after the 2020 presidential election and continuing today with anti-democratic efforts in many states to curtail voting rights, are downright scary. The Supreme Court’s recent decision on Section 2 of the Voting Rights Act, which undermined the provision that bars discriminatory practices in voting, raises the stakes for Congress to pass the John Lewis Voting Rights Act.

In its Fulton decision, the Supreme Court did not take any sweeping steps to curtail anti-discrimination protections for LGBTQ+ individuals. That decision, which was confined to the facts of a particular Philadelphia program governing whether gay and lesbian couples could be refused access to foster care services based on the religious objection of a contractor, leaves in place the basic governing standard and does not disturb, for example, Colorado’s equality protections. But we know that attacks on anti-discrimination protections for LGBTQ+ individuals will continue to come. And we will be ready to meet them head on.

On a positive note, the Affordable Care Act survived yet another challenge this past Supreme Court term. The U.S. Department of Justice’s decision to attack the law was an assault on health care that would have harmed 400,000 Coloradans with health care due to the Medicaid expansion and 700,000 Coloradans who benefited from the ban on discriminating against persons with pre-existing conditions. And it was an assault on the rule of law itself, as the DOJ refused to defend the law. Thankfully, we prevailed.

As we celebrate July 4th, we will redouble our efforts to defend our democratic republic and the rights of every Coloradan.
