On Thursday, Justice Stephen Breyer did not announce that he will be retiring from the Supreme Court this session.
Breyer's decision to delay his retirement comes at a precarious time. Our Democratic majority in the Senate is razor thin, and Republicans are hoping to reclaim the Senate in the 2022 elections. If Mitch McConnell does become Senate Majority Leader again, we know that there will be no chance for Biden to fill a vacancy on the Supreme Court, and we'll have to wait for another Democratic trifecta to bring new justices to the bench
This is scary news for Democrats. We're already at a disadvantage with only three liberal Justices on the court, and we can't afford to allow a conservative majority to make decisions on voting rights, reproductive rights, gun laws, and so much more for decades to come.
These are dire times on the Court. The longer Breyer remains, the more likely a Republican president choosing his successor becomes . President Biden has vowed to fill a Supreme Court vacancy with a Black woman. If Breyer leaves now, President Biden can name the first Black female justice while Republican senators lack the votes to block the nomination.
