Why should Justice Breyer step aside? It’s pretty clear:
- Amy Coney Barrett was confirmed to the Supreme Court just 8 days before the presidential election.
- Merrick Garland wasn’t even allowed a hearing 9 months before the 2016 election.
- Just this week, Mitch McConnell pledged to block Biden’s Supreme Court pick in 2024.
If Justice Breyer doesn’t step down, he’ll be clearing the path to let Mitch McConnell and the GOP further entrench Republican power on the Court, putting our rights and our democracy at risk for the foreseeable future. You saw how Trump and McConnell abused their power to consolidate control at the Court in just four years -- we can’t let that happen again.
Breyer has been a distinguished justice, but he is now risking the Senate falling into Republican hands before Democrats can confirm a Biden nominee to replace him. He must give President Biden the opportunity to nominate his successor and fulfill his promise of nominating the first Black woman Supreme Court justice.
