Like women’s sports, prisons pose real problems for transgender people. Sending a transgender woman to a men’s prison will almost certainly result in repeated sexual assault. Yet, housing transgender people in the prisons reflecting their gender identity is equally problematic for those who are not transgender. Everyone must be held accountable for breaking the law. But regardless of how we feel about transgender issues, the government has a Constitutional responsibility to keep people safe when they are behind bars. No one is sentenced to being raped. ACU Foundation’s David Safavian recently wrote an op-ed for Governing Magazine advocating for a third option: leverage the private sector to house transgender inmates.
