COURT MATTERS

SCOTUS agrees to take a case challenging Roe v Wade. The case arises from a Mississippi law that bans most abortions after 15 weeks of pregnancy, which is about two months earlier than Roe v Wade and subsequent decisions and could undermine the constitutional right.

Biden Judicial nominees voted out of the Senate Judiciary Committee. The Senate Judiciary Committee approved President Biden’s first two appeals court nominees: Judge Ketanji Brown Jackson nominated to the U.S. Court of Appeals for the District of Columbia Circuit, and Candace Jackson-Akiwumi, nominee for the 7th Circuit U.S. Court of Appeals. Both nominees are Black women, part of the Administration’s goal to diversify the federal bench.

FEDERAL MATTERS

President Biden issues a proclamation on International Day Against Homophobia, Biphobia and Transphobia (IDAHOBIT). The statement notes global progress on LGBTQ+ rights and includes the effects of COVID-19 that widen economic, social, and safety gaps for LGBTQI+ people — and that an epidemic of violence still rages for trans people, especially women of color. It also notes gaps in nondiscrimination protections in many U.S. states.

Administration outlines actions taken to protect LGBTQ+ people internationally. This fact sheet includes information on ongoing diplomatic work, including launching an interagency working group to advance LGBTQI+ human rights in the work of the Organization of American States (OAS), African Union, and Association of South East Asian Nations, as well as USAID capacity building to combat criminalization of LGBTQI+ status or conduct. 

President Biden signs COVID-19 Hate Crimes Act, including the Jabara-Heyer NO HATE Act, into law. The law, endorsed by PFLAG National, addresses hate crimes throughout the COVID-19 pandemic, particularly violence against Asian Americans and provisions called for in the Jabara-Heyer NO HATE Act..

Kristen Clarke was historically confirmed as DOJ’s Assistant Attorney General for Civil Rights, making her the first Black woman to lead that DOJ Division.  AAG Clarke’s bipartisan Senate confirmation vote was on the one-year mark of George Floyd’s murder.

Alabama - Trans healthcare ban dies on the Alabama House floor. Under the proposed bill, medical professionals could have faced a 10-year prison sentence or a $15,000 fine for providing needed gender-affirming treatment. Kaitlin Welborn, an attorney for the ACLU of Alabama, said the death of this bill should be heralded as a “victory” for the trans community in Alabama.

Arkansas - ACLU sues Arkansas over trans healthcare ban. The suit was filed on behalf of four trans youths and their parents, as well as two physicians who provide gender-affirming health care. Gov. Asa Hutchinson vetoed the bill in April, calling it a “vast government overreach,” but the Legislature overrode the veto a day later, making Arkansas the first in the country to pass a restriction on transition-related health care. 

District of Columbia. - Vigil held for two D.C. trans women. Almost 100 people attended the May 21st vigil in River Terrace Parkto honor the lives of Nona Moselle Conner, 37, and Gisselle Hartzog, 30. Friends and LGBTQ activists who participated in the vigil called on the community to honor the two women by speaking out and taking action to address the struggles that they and many other transgender women of color have endured due to prejudice and discrimination. 

Indiana - South Madison School Board orders three teachers to remove rainbow flags from their classrooms. District officials said that pride flags violate the school's no "political paraphernalia" policy.

Oklahoma - State legislature adjourns without enacting SB2, the anti-trans student athlete bill. Senate Pro Tempore Greg Treat (R-Oklahoma City) called the legislation “"a solution in search of a problem today."

Pennsylvania - Tyler Titus wins primary election for Erie County Executive. If Titus, who currently serves as President of the Erie County School Board, wins the General Election in November, they will become the first openly trans county executive in the country. 

Lawmakers vote down amendment to remove homosexuality from state obscenity law. Current law bans “the distribution to minors of materials such as books, pictures, and videos which depict ‘acts of homosexuality.'”

Tennessee - Gov. Lee signs anti-trans bathroom bills. Tennessee will become the first state in the United States to require businesses and government facilities open to the public to post a sign if they let transgender people use multiperson bathrooms, locker rooms or changing rooms associated with their gender identity. Gov. Lee also signed a bill that puts public schools and their districts at risk in civil lawsuits if they let transgender students or employees use multiperson bathrooms or locker rooms that do not reflect their sex at birth. 

Texas - Trans athlete ban dies in Texas House regular session. SB29, a trans athlete ban, died in the House after missing the deadline Tuesday night for passing all Senate bills. SB29 was among 13 anti-trans bills the legislature considered this session, all of which missed deadlines of consideration and died in the State House. PFLAGers across the state remain vigilant, however, as there are some lawmakers asking the Governor to call a Special Session specifically to re-address some of the anti-trans bills.

GLOBAL MATTERS

Ghana - Ghanian police arrest 21 LGBTQ+ rights advocates. Ghanaian police cited “unlawful assembly” and promoting an LGBTQ+ agenda as the reasons for the arrests, which came after a group of journalists came to an event by Rightify Ghana, which was held to provide training for activists and paralegals when supporting LGBTQ+ people. 

Italy - Italian Senate considers law criminalizing violence and hate speech against LGBTQ+ people. The law passed the lower house last year but faces obstacles in the Senate and significant opposition from a wide variety of groups. 

Japan - Japanese lawmaker says LGBTQ+ rights go against the preservation of speciesDuring a Liberal Democratic party meeting, Kazuo Yan, a member of the Japanese House of Representatives, reportedly told members that LGBTQ+ people run counter to the basis of biology.

MEDIA MATTERS

Karine Jean Pierre makes history in the White House briefing room. Jean-Pierre is the first openly gay spokeswoman and second Black woman to brief the press from the White House briefing room podium. Jean-Pierre is a friend to PFLAG National, having served as a speaker at We Are the Change: The 2019 PFLAG National Convention, in Kansas City.

Demi Lovato comes out as non binary. Singer Demi Lovato revealed they are nonbinary, telling fans they are "proud" to make the change after "a lot of self-reflective work."

Billy Porter discloses HIV+ status. Porter revealed he has been living with HIV for 14 years. Porter said that, as a gay Black man, the shame ignited by his religious upbringing and the fear of career repercussions had prevented him from speaking out earlier.

Study shows LGBTQ+-friendly companies more profitable. Academics at two universities in Finland assessed the financial performance of 657 publicly-traded U.S. companies between 2003 and 2016, and found that firms with LGBTQ+-friendly policies tend to enjoy both higher profitability and higher stock market valuations.

Current and former transgender and nonbinary college athletes send letter to the NCAA criticizing events in states with anti-trans athlete bans. The athletes criticized the governing body’s May 16th decision to schedule new softball regional tournament events in three states—Alabama, Arkansas and Tennessee—that have passed anti-trans sports bills.

Marvel releases trailer for first film to feature a gay superhero. Eternals will star Brian Tyree Henry as Phastos, an intelligent cosmic-powered inventor who secretly helps humanity progress technologically and the Marvel Cinematic Universe’s first openly gay superhero.

Writer James Factora publishes fact-filled, passionate response to 60 Minutes problematic segment on anti-trans legislation in the U.S. 60 Minutes highly problematic piece aired Sunday, May 23rd, and generated immediate backlash.
