The best news of the week may come from New York, but it could have positive consequences for California.
As we have reported previously, GOC filed two amicus briefs in the New York State Rifle & Pistol Association v. City of New York case, which pertains to the legal transportation of firearms. But there is a bigger implication in that the court may rule on the level of “scrutiny” that ALL courts will be required to use when deciding 2nd Amendment cases. If the court mandates – as the late Justice Scalia directed in Heller v. DC, that judges can only use the text, history and tradition of the meaning of the words at the founding, the door will be wide open to challenging a host of unconstitutional laws across the nation. Oral arguments are set for December 2. Stay tuned.
