The Biden administration is repealing a last-minute Trump-era regulation intended to restrict the ability of the Environmental Protection Agency to curb air pollution.
Lobbyists for the fossil fuel industry promoted the “cost-benefit” rule in an effort to stymie environmental safeguards.
With the “cost-benefit” requirement in place, the fossil fuel industry would have been able to block future EPA air pollution rules.
The regulation changed how the EPA calculated the economic costs and benefits of new clean air and climate change rules. This allowed the agency to avoid applying an economic value to specific public health benefits if the scientific evidence was deemed “limited.”
It was one final significant achievement for the fossil fuel industry as the Trump administration came to a close. By reversing this rule, the Biden administration is showing its commitment to using the best available science and economic best practices to develop clean air regulations.
It also ends what the Trump administration’s last EPA administrator acknowledged was the true intent of the last-minute regulation: Preventing future administrations from imposing restrictions on toxic mercury pollution from power plants, as happened during the Obama administration.
