Recently, Tennessee Governor Bill Lee signed a bill that modernized the state’s intellectual disability law and prevents the unconstitutional execution of people with intellectual disabilities like Pervis Payne, who’s been on death row for 33 years. The legislation, which was inspired by Pervis’ case, passed both chambers of the Tennessee legislature with overwhelming bipartisan support.

This allowed Pervis’ legal team to file a petition to present his intellectual disability claim in court last week. This is huge news, but the fight isn’t over.

Shelby County District Attorney Amy Weirich could still dispute Pervis’ intellectual disability claim, which would draw out his case another three to five years — and she’s already blamed Pervis for not filing this claim earlier, even though it wasn’t possible for him to do so until Governor Lee signed the new legislation into law.

The State has never before disputed or contested that Pervis has an intellectual disability and D.A. Weirich should not delay justice by doing so now.

We need to put the pressure on right now. Will you share this link on social media and encourage people in Tennessee to email D.A. Weirich and tell her it’s time to do the right thing and agree that Pervis Payne is a person with an intellectual disability?

We believe that D.A. Weirich shouldn’t waste taxpayer money and valuable time fighting against the unassailable truth: Pervis Payne has an undisputed intellectual disability, and he should be removed from death row immediately.
