New Lawsuit: We’re Suing the Arizona Senate to Release Audit Records

On Wednesday afternoon, we sued the Arizona Senate under Arizona’s public records law for failing to release key documents related to the partisan audit of the 2020 general election ballots cast in Maricopa County. 
 
The audit, led by Arizona Senate President Karen Fann and Senate Republicans, is being conducted by the firm Cyber Ninjas, a Florida company with no experience in reviewing elections. It has been widely criticized as a blatant attempt to undermine confidence in democracy, create false justifications for new restrictions on voting, and further the “Big Lie” that the 2020 election was “stolen” from Donald Trump.

We immediately launched an investigation. We asked for the public release of documents including plans for securing election materials, investigation techniques, information about costs and payments made for the audit, and more. 
 
The Senate released a handful of files, but has maintained that the remaining records are not in its possession and, therefore, are not public records.

Now, we’re going to court. The public urgently needs transparency around the audit and the conduct of the Senate and Cyber Ninjas. Local and national reporting have raised significant questions about the audit’s integrity. 
 
Our lawsuit asks a judge to enforce Arizona law by compelling the Senate to promptly produce responsive records — so the public can determine whether the audit is intended to return legitimate results through a secure and honest process or to serve specific political ends.
