The Federalist Society states that today's law schools promote a “liberal ideology which advocates a centralized and uniform society.” The society promotes the idea that “the state exists to preserve freedom, that the separation of governmental powers is central to our constitution, and that it is emphatically the province and duty of the judiciary to say what the law is, not what the law should be.” For twelve years, A.J. has also been the General Counsel of the Oklahoma Republican Party. We have asked him to speak to OCPAC because he is on the front lines of the conservative legal movement. He will discuss some of the better ways available to select Oklahoma judges. A.J. wants to also discuss decisions the U.S. Supreme Court has handed down. There have been some decisions which have been more pro-life than those of our own Oklahoma court. BOB LINN Secularism and the Courts Once grounded in constitutional bedrock, “The Court” is now a self-determined cartel mandating legislative authority over federal, state, and local governments. Having mandated the right to abortion and sodomy, it has been a force not for constitutional scholarship, but for leftist social engineering. As you and I slept, our constitutional republic was being usurped. The core may be traced to Eden’s apple and the age-old sin of Adam. America has jettisoned the Biblical foundations of her founders in exchange for the imaginations of men who no longer reverence their Creator. The 1859 publication of Darwin’s Origin of the Species began an unholy cultural tide which unraveled our national fabric on many fronts. We were introduced to racist anthropology, theological skepticism, and moral relativism. We were released from the Law of God, the cornerstone of American jurisprudence. The Court no longer saw the words of the constitution as immutable (except by legislative amendment), but as evolving in Darwin’s stylish secularism by judicial decree. The impact of Charles Darwin’s ideas caught the attention of many in the field of legal jurisprudence. Yale professor Dr. Fred V. Cahill was one who saw the impact with great clarity. In 1952, Dr. Cahill, stated that Darwin’s theory “was an event of transcending importance to the development of American jurisprudence … This involved a shift from the rationalistic, deductive pattern of the pre-Darwinian period, to the empirical, evolutionary approach that is followed today.” With the loosening of ties to our nation's Constitution came a focus in the legal community on case law. In the 1870s, the Dean of Harvard Law School, Christopher Langdell, introduced Darwinian thought to Harvard’s legal education. He jettisoned traditional Blackstonian law for what is now called “case law” (judicial court decisions). Rather than studying the legislative law (the Constitution, for example), our future lawyers and judges focused on “case law” (judicial opinions rendered in the courts). Langdell’s new direction was revolutionary. Harvard students were taught that law was ever-changing. It evolved through the written opinions of appellate judges. This was completely the opposite of Blackstonian law which held that judges’ opinions were not law. With Langdell (and just about everyone since), judicial opinion was indeed considered new law! It was in 1918 that President Woodrow Wilson, a Princeton man, followed the Harvard direction in his perspective on the role of the judiciary as a challenger to the role of the U.S. Constitution. Wilson stated of the U.S. Constitution, “It is modified by its environment, necessitated by its tasks…Living political constitutions must be Darwinian in structure and in practice … “evolution” is the scientific word to interpret the constitution according to the Darwinian principle.” How do we get back on track? We must reclaim our pulpits for Christ! As long as pastors refuse to bear the mantle of Biblical prophets and cultural leader, we will continue in decline. Reclaiming the culture means the transformation of our educational institutions, our entertainment, and our news media. Like the citizens of the 16thand 17th centuries, we need preachers to light the way. We must so recover our Biblical foundations that we see government and education as our founders did. Biblical thinkers like Supreme Court Judge Joseph Story serve as examples to show us the way. Joseph Story served on the Court from 1812 to 1845. His service was so distinguished and filled with accomplishment that his life was center stage in the Stephen Spielberg film, Amistad. In his essay on natural law, he wrote that “the whole duty of man” is to ascertain and obey the will of God! There is a war raging to remove the Christian foundations of our nation. Forces of evil have attacked the American constitution and the culture it protects for more than a century. We have a divine calling to prevent the enemy of Christianity and the American Republic it created to achieve their objective. Our activism is not optional. I'll see you this Wednesday! God bless! Finally, H.R.1 & S.1, (if passed), would destroy election fairness and allow Democrats to forever remain in power violating our Constitution and ending our Representative Republic. Aside from the election, the Current Administration has launched a full-blown assault on our Constitutional rights in a dictatorial manner, bypassing the Congress, with more than 50 Executive Orders quickly signed, many reversing the previous Administration’s effective policies and regulations. Moreover, population control actions such as excessive lockdowns, school and business closures, and most alarming, censorship of written and verbal expression are all direct assaults on our fundamental Rights. We must support and hold accountable politicians who will act to counter Socialism, Marxism and Progressivism, support our Constitutional Republic, and insist on fiscally responsible governing while focusing on all Americans, especially the middle class, not special interest or extremist groups which are used to divide us into warring factions. To begin, it is a refreshing feeling to hear the president make sense when he speaks. That is not to say that I agree with all that he is putting forth, but it is coherent. It has been a long time that I have heard a president talk about raising the minimum wage, a plan for creating jobs, recognition of climate change and how to address it, and ending loopholes for big corporations that pay no taxes. This is big. It is also important when he openly states that “trickle down has never worked” or that “White Supremacy is terrorism.” Key to keep in mind is that he is addressing many of the demands that movements across the country have been calling for. It is important to recognize that the movements have forced the issues which he is addressing. It is the movements that must continue the pressure because, as we all know, the president can’t make it all happen on his own. RYAN WALTERS Defending 1775 The Ban on CRT Last week, Ryan Walters published an article in the Tulsa World defending the ban on the racist messaging inherent in Critical Race Theory. From the Tulsa World by Ryan Walters As a history teacher, it is important to me that students receive an accurate depiction of the past. In order for students to grasp the full lessons of history, students must see both the moments that made America great, as well as those moments we fell woefully short of the principles of liberty espoused in our founding documents. So how does the passage of HB 1775 change my role as a history teacher? It doesn’t. HB 1775 explicitly states that teachers shall not be prohibited from teaching the Oklahoma Academic Standards, which were written by Oklahoma educators and include events like the emergence of Black Wall Street, the Tulsa Race Massacre, the Oklahoma City lunch counter sit-ins led by Clara Luper, and the Trail of Tears. I know this because I was one of the educators that wrote the standards prior to being named Oklahoma’s secretary of education. This bill would not censor history or make it difficult for teachers to teach about the painful moments of our past. What this bill will do is ensure that Oklahoma students in grades K-12 will not be instructed by their teachers that one race is inherently superior to another race. Students may not be taught they are “oppressors” because of their race or sex. Teachers may not mandate as part of a course that a student should feel discomfort or guilt on account of a student’s race or sex. Schools must make clear that it is unacceptable to judge a peer based on his or her race or sex. In short, HB 1775 safeguards Oklahoma schools from state-sponsored racism and sexism. There are tragic consequences when young people do not see that all men and women are created equal under God. This year we will recognize the 100—year anniversary of the Tulsa Race Massacre, a horrific stain on our state and our nation’s history that arose from a dangerous disregard for the dignity of human life and the evils of racism. As Oklahoma educators, it is our responsibility to teach this tragedy to our students. It is also our responsibility to teach our past without prejudging those responsible for our future. We must also teach about the imperfect individuals who made this country the greatest nation in the world. We must teach about the foresight and wisdom of Thomas Jefferson, who recognized the unalienable rights of all Americans in the Declaration of Independence. We must teach the bravery and confidence of Abraham Lincoln, who reaffirmed post-Civil War “a new nation, conceived in Liberty, and dedicated to the proposition that all men are created equal.” We must teach the courage and heroism of individuals like Martin Luther King, Jr., who called for our country to live up to the principles of equality and liberty espoused by the founders of our country. This bill does not fix all our problems, but it does make clear that in Oklahoma we will not allow our students to be exposed to radical government-mandated indoctrination that teaches students to define themselves by the color of their skin color rather than the content of their character. There is always progress to be made, but teaching our children to focus on what unites us rather than what divides us is a pretty good place to start. And that is a great lesson for us all. STATE AUDITOR 168 Days NO CREDENTIALS TO CONDUCT GOVERNMENT AUDITS by Bob Linn At 168 days, I still have not received many of the elements of my Open Records request of last year. I am wanting to know how the Oklahoma Department of Health scammed the Oklahoma taxpayer out of $30 million and used the scam to fire 198 rural healthcare worker all across the state. Two weeks ago, the paid media representative of the state auditor, Cindy Byrd, informed us that her registration with the Oklahoma Accountancy Board is registered under Cynthia Byrd. This was a surprise, as it is a name she has not used on the voter ballot and the SA&I web site. The attorneys we are working with indicated they would never have thought to look for this alias. The chart above is found at the Oklahoma Accountancy Board here. We now know that our state auditor does not have the credentials to perform the task for which we elected her. She has no certification to perform government audits. Clearly, we need a new state auditor. A CPA who checks all the boxes. Steve Anderson, by the way, is not a candidate. Perhaps Cindy, AKA Cynthia, will have an answer for us before another 168 days pass by. Cindy (Cynthia?) Byrd would have done herself a favor by simply complying 161 days ago with the information about the Oklahoma Health Department audits. These have entered our Christian institutions in an effort to destroy the Church. The "gospel" they promote will bear no fruit. Marxist ideology mixed with Bible verses will produce neither salvation nor the health, peace, and prosperity of civilizations. Marxist concepts like social justice, critical race theory and the myths inherent in the concept of "white privilege" are ungodly, contrary to all of the Scriptures, and represent evil and destructive weapons designed to destroy the church, the family, and societies. They are drenched in narcissism and hatred. These ideas, now permeating most of our seminaries and academic institutions (beginning in elementary school), will soon destroy the nation if we do not expose them for the evil they represent.
