Are your donation records safe from political scrutiny?
When Kamala Harris was Attorney General, the state of California demanded that nonprofits release their 990-Schedule B donor lists to the government.
As is all too often the case with data that should be kept private, California inadvertently disclosed the information. This should be a red flag for anyone who donates to nonprofits, especially in the current divisive political environment.
But now the radical Left wants harsh legislation forcing nonprofits to release their donor lists just for advocating on behalf of citizens -- and two cases before the U.S. Supreme Court could give them the green light to do so. Why?
The Left wishes to harass conservative donors, out them through the “Mainstream” Media, and discourage us from organizing. Let me be clear: This is a SURVIVAL issue for our movement.
All is not lost, Fellow Conservative. There is a powerful organization fighting back.
I want to introduce you to my friend Pete Sepp. Pete is the President of the National Taxpayers Union (NTU) and National Taxpayers Union Foundation (NTUF). FULL DISCLOSURE: I sit on the board of NTU, and I have followed with admiration the work of NTUF as well.
But I do believe NTU and NTUF are among the most critical organizations in the country fighting for donors and taxpayers in the United States.
How can we stand up to the state of California and the nationwide push to publicize conservative donors?
Fortunately, NTUF recently created the Taxpayer Defense Center (TDC) to fight for taxpayers against draconian tax laws in the courts. When it comes to tax laws, it is often guilty until proven innocent. TDC has just filed a friend of the court brief in Americans for Prosperity Foundation v. Becerra and Thomas More Law Center v. Becerra which are the cases in California. But there’s so much more work to do.

With a new administration in the White House, and Congress controlled by Nancy Pelosi, I know we will need an organization like NTUF’s Taxpayer Defense Center to stop future tax hikes and defend taxpayers in court.
The Taxpayer Defense Center has already made a powerful impact in these cases. - New Hampshire v. Massachusetts -- The Center led a brief that was co-signed by 16 other free-market nonprofits urging the Supreme Court to stop Massachusetts from overstepping its taxing powers.
- Oakbrook Holdings v. Commissioner -- The Center was the only public interest litigation group filing a brief in this Sixth Circuit case, which involves the IRS. Our brief argues that the IRS’s shifting position on regulations has put taxpayers who wanted to follow the law in an impossible situation.
- CIC Services v. Internal Revenue Service - The Court will decide important issues relating to a taxpayer’s right to seek injunctions against the IRS as well as the often-disregarded public notice and comment process for tax regulations.
