Nolan Center for Justice

The criminal justice team helped notch two more wins this week, both in the State of Georgia. Last Thursday, Governor Brian Kemp enacted House Bill 345, which bans the shackling of pregnant inmates in state prisons as well as in county and local jails. And on Monday, Kemp signed into law Senate Bill 105, which reforms Georgia’s probation system to make it easier for ex-offenders to successfully re-enter and become more productive members of society. Our own Kaitlin Owens was a regular voice in the state capitol over the past year, working with conservative legislators to pass both of these Republican-sponsored bills. And her had work paid off.

 

On Thursday, ACU General Counsel David Safavian gave keynote remarks to the Michigan Judicial Conference, a meeting of all 360 state judges at the district, circuit, appellate and Supreme Court levels in his home state. His topic was a controversial one. The Presumption of Innocence is dead…or at least on life support. “Three factors are destroying the presumption of innocence in American courts: (1) the rise of social media as a channel for news delivery; (2) the impact of political tribalism and confirmation bias; and (3) mob rule and the online cancel culture. Taken together, the impact of these forces make juries much more susceptible to outside pressures when they should be putting the government to its proofs.”

 

Lastly, the CJR team was recently lauded by the head of the Crime and Justice Institute for ACU’s work with Gov. Bill Lee in Tennessee:  

 

“Just a quick note to thank you for your ever-present and always-vital clarity and assessment in Tennessee. Patrick [Plein’s] presence during the hearings a couple weeks ago and your messaging the last few weeks was hugely important as the clock wound down. We met with dozens of legislators and many of them either referred to the ACU one-pager or asked what your position was on the various issues addressed in the bills. Your constant support and effective communications has moved another state into the “moving in the right direction” column.”
