The final day of Kenneth Ferguson’s employment tribunal hearing takes place this Monday, 10 May.
The Institute has been helping Kenneth in his legal action for unfair dismissal and religious discrimination against The Robertson Trust. The long-serving and highly successful CEO was dismissed after Chairwoman Shonaig Macpherson heard that his church was renting Trust premises for its Sunday services.
The Trust blamed Mr Ferguson for the arrangement with the church, despite him recusing himself from all negotiations about the rental.
The tribunal heard three days of evidence in December. It was argued that Kenneth was sacked without proper procedures being followed because Macpherson was angered that his church, Stirling Free Church, ‘doesn’t believe in same-sex marriage’. One of his colleagues said the Chairwoman was “appalled at the idea of the Free Church using a Trust space”. Another warned him that she was “on the warpath”.
The church also had its contract terminated. With the Institute’s help, Stirling Free Church is bringing a separate claim for religious discrimination against the Trust.
