BREAKING: The major federal court decision on Ajit Pai's repeal of net neutrality just came down.

We're still analyzing the order, and we'll send out a full update on exactly what it means very soon. But one thing we know for sure is that the court threw out the part of the rule that blocks states from enacting their own state protections, which is huge.

Now, Comcast and AT&T are about to swarm Washington, DC, with lobbyists to try to get Congress to block state action and to kill net neutrality once and for all.

The court ruling upheld at least some parts of Ajit Pai's net neutrality repeal, which is a big disappointment. But one big part of Pai's net neutrality repeal was thrown out: state preemption.

Here's the deal: the FCC's repeal of net neutrality contained a provision saying that state governments may not enact their own strong net neutrality protections. So for instance, the rule blocked the gold standard net neutrality law that passed the California Assembly.

Today's ruling throws out the preemption of state net neutrality rules, meaning we can now work to pass strong net neutrality rules state by state all over the country—and there are already several states poised to do just that.

But now, Big Cable lobbyists are getting ready to swarm Capitol Hill to pass bad legislation that will end net neutrality forever by both preempting the states AND blocking any future president or FCC from enacting strong net neutrality protections.

This is the most important moment for net neutrality that we've seen in years. We need to spring into action RIGHT NOW to stop Big Cable from passing anti-net neutrality legislation in Congress, and we need to begin working with pro-net neutrality governors and state legislators to pass strong net neutrality protections in as many states as possible. We'll also keep working to pass the Save the Internet Act, the only bill that would protect net neutrality nationwide.
