New IDP Resources on Biden’s Enforcement Guidelines


IDP released two comprehensive practice advisories this week with ILRC and NIPNLG to help attorneys understand changes that the Biden administration has announced to immigration enforcement. The two resources—one for immigration attorneys and the other for criminal defense attorneys—provide an overview of the key policy changes and interim priorities announced by the Biden administration so far. They also include strategies for pursuing prosecutorial discretion and sample requests.

In order to help the community understand these changes, IDP has also updated our widely-used Know Your Rights flyers and booklets in English and Spanish. IDP’s Know Your Rights resources explain who is at risk of being arrested by ICE and briefly describe what you can do if you encounter ICE at home and in public. Eyes on ICE: Automatic License Plate Readers


In response to ICE’s increased use of Automatic License Plate Readers to track and surveil people in cars, IDP has created a community resource to raise awareness and inform people of their rights. This new community resource builds on IDP’s 2020 guide ICE Stopped My Car, What Are My Rights? and the associated infographics and practice advisory. A Spanish version of this resource is forthcoming. 

ICE's use of shared databases, like the one used by ALPRs, have been highlighted in a 2019 article in The New York Times and are one of the many reasons why states like New York must strengthen our laws to prevent the sharing of personal information with ICE.

Two victories for the Justice Roadmap Coalition!


Fighting to stop the use of solitary confinement has been a key prong of the Justice Roadmap, and, late last week, we celebrated the New York State Legislature’s passage of the Humane Alternatives to Solitary Confinement Act, or HALT. This long-overdue legislation will prohibit the use of isolated confinement for longer than 15 days and create Residential Rehabilitation Units (RRU) – providing programs, therapy, and support to address underlying needs and causes of behavior for people separated from the general population. 
The passage of this bill is both a victory for supporters of the #HALT bill and communities across New York that have sought justice for the wrongful deaths of Kalief Browder and Layleen Polanco, both of whom were subject to solitary confinement at Rikers Island.

Julio + Friends: A Do-athon to Rein in ICE!

 
Last Thursday, the New York Civil Liberties Union hosted “Julio + Friends: a Do-athon to Rein in ICE,” in support of the New York for All Act. Joined by SNL-writer and star of HBO’s Los Espookys, Julio Torres, attendees were treated to performances by a number of talented comedians, including Bowen Yang, John Early, Lorelei Ramirez, Larry Owens, and Sydnee Washington. Julio and the NYCLU offered step-by-step ways that viewers could demand that New York stop enabling ICE’s deportation machine. The New York for All Act, championed by IDP, the New York Civil Liberties Union, and the New York Immigration Coalition, would prohibit New York’s state and local agencies—including police—from collaborating with ICE, funneling people into ICE custody, or from disclosing sensitive information.
