That law arguably forbids states that take federal stimulus money from enacting ANY tax cutting policies.
The onerous restriction applies even if the stimulus money isn’t being DIRECTLY used for tax relief.
In our announcement today, which we co-led with Arizona and Georgia, I made clear to the Biden Administration that my colleagues and I will FILE a LAWSUIT to strike down this unlawful federal tax mandate if they don’t make clear that the policy is unenforceable.
Can you imagine Congress trying to prevent a state from using its constitutional power to lower taxes— even if the monies for the tax cut don’t come from the federal government?
West Virginia and GOP Attorneys General won’t allow that to happen without a fight.
