SB 21-173, Rights In Residential Lease Agreements prevents landlords from charging exorbitant late fees and enacts a number of critical eviction court reforms. The bill establishes penalties for illegal evictions and repeals the “pay-to-play” bond system that requires tenants to pay bonds before using habitability complaints as a defense, among other changes.

SB21-62, Jail Population Management Tools seeks to address mass incarceration in Colorado by adopting a narrow set of the jail population reduction policies put in place during the COVID-19 crisis and enshrining them into law going forward. It is aimed at keeping people accused of low-level crimes out of jail, ensuring jails are reserved only for people who pose a flight risk or public safety threat. It increases the use of summons in lieu of arrest, and greatly decreases the use of cash bonds.
SB21-062 could potentially reduce Colorado’s jail population by over 33%+. This bill is the product of a collaboration between state lawmakers, the Colorado ACLU, the Colorado Freedom Fund, public defender organizations, and progressive prosecutors. It is the first of 3 bills that Elisabeth Epps of the Colorado Freedom Fund is working hard to get passed through the State Senate in 2021. SB21-062 is facing tough opposition from Boulder NIMBY groups, Boulder’s Mayor Pelle, and several police organizations.
