The Department of Justice’s “China Initiative” has unfairly targeted and profiled Asian American and Asian immigrant scientists, researchers, and scholars — particularly those of Chinese descent. Federal agencies have led grant fraud investigations against Asian American and Asian immigrant scientists and researchers. This has included criminalizing errors such as failing to disclose certain information to universities, research institutions, or federal agencies, which has ruined careers and left lives in shambles. In this educational webinar, you will hear from attorneys on how to navigate current guidelines from federal grantmaking agencies on the disclosure of foreign activities, including conflict of interest and current and pending support disclosures in grant applications. The panelists will also discuss tax and foreign bank account reporting obligations associated with foreign income received by U.S. researchers.

Speakers:

* John C. Yang is the president and executive director of Asian Americans Advancing Justice | AAJC in Washington, D.C., where he leads the organization’s mission to advance the civil and human rights of Asian Americans and to build and promote a fair and equitable society for all through policy advocacy, education, and litigation. He has served in leadership positions for the American Bar Association, the National Asian Pacific American Bar Association, and the National Council of Asian Pacific Americans, among many others. Prior to Advancing Justice | AAJC, John had served as a political appointee in the Obama Administration addressing U.S. trade and economics, the Asia-Pacific Legal Director based in Shanghai, China, of a Fortune 200 company, and as a partner at a large DC-based law firm. He also serves on the diversity council for several Fortune 500 U.S. companies. John is fluent in Mandarin Chinese.

* Peter Zeidenberg is a Partner at Arent Fox LLP. Peter’s practice focuses on the representation of scientists, academics, entrepreneurs, and other individuals and business organizations accused or suspected of economic espionage, theft of trade secrets, government contracting and procurement fraud, export violations, espionage-related offenses, computer crimes, the False Claims Act, wire and mail fraud, and the Foreign Corrupt Practices Act. He has had tremendous success in persuading the government to decline to bring prosecutions as well as convincing prosecutors to dismiss cases that have already been brought. If a trial is necessary, Peter has a long track record, with scores of jury trials while at the Department of Justice and in private practice. Peter is experienced in conducting internal investigations and counseling companies and organizations responding to government enforcement threats. His work in such matters includes grand jury investigations, administrative subpoenas, and
Congressional investigations, with a particular focus on criminal trials.

* Catherine X. Pan-Giordano is a Partner at Dorsey & Whitney LLP and Corporate Group Head in the firm’s New York office and leads the firm’s globally recognized U.S.-China transactional practice.
