PEN America v. Trump Lawsuit
Today, we at PEN America and our counsel Protect Democracy settled our 2018 lawsuit, PEN America v. Trump, with the United States government. 

In short, the agreement we reached today says that no president can use the machinery of government to punish or retaliate against reporters. This is a precedent-setting victory. Not only for PEN America and its Members, but also for free speech and its champions everywhere. 
 
HELP US CONTINUE CHAMPIONING FREE SPEECH

This settlement leaves intact a March 2020 federal court ruling that upheld our standing to pursue a challenge to former President Trump’s threats against members of the press, but it also sends a message that is loud and clear: No one, not even the president of the United States can invoke the power of government to threaten members of the press based on their coverage, and in future, such abuses of power can be held to account in court. All because of support from free speech champions and advocates like you. We are so grateful to you for being part of this fight, including by sharing your experiences and helping amplify the message of our case.

But threats to free speech are ongoing, and as we’ve seen, Trump’s authoritarian behavior has helped to fuel a dangerous maelstrom of anti-media bias and disinformation. We can’t sit back and allow these precedents to inform the next four years and beyond.
