With the end of the Trump presidency, many people have been asking me what happens now with the Emoluments suit that I, along with my colleague, Karl Racine, DC's Attorney General, filed against Donald Trump. Although his departure from office has effectively terminated the case against him, the opinion rendered by the Maryland federal district court clearly established that the US Constitution forbids the president from accepting anything of value from any foreign or domestic government. That opinion will guide judicial analysis in the future should another president attempt to abuse the office.
In addition, there is now an opportunity in Congress to pass legislation that would create tough ethics rules that would apply to the president andvice president -- including requiring them to divest from business ties and to disclose tax returns -- making absolutely clear that conduct like Donald Trump's is illegal. If we have learned anything over the last four years, it is that no president should be above the law. No president should be allowed to use that office to further personal and business interests or to use the White House for financial gain. Now is the time to make sure this never happens again.
