It’s official, John.

The Dakota Access pipeline is operating illegally without a key permit.

Now, the Biden Administration must decide by February 10 whether to shut it down while the government does a court-ordered environmental review — or allow it to continue to operate illegally.

We have a chance for Biden to shut down this pipeline now while we wait for a robust review that could shut down the pipeline permanently. But that will only happen if his administration feels the pressure from our movement.

The pipeline was originally slated to cross the Missouri River north of Bismarck, North Dakota, until the risk of an oil spill to the city’s 90% white inhabitants was deemed too great.

As a result, the new crossing site shifted the risk to the Standing Rock Sioux Tribe, in a location of key religious and cultural importance to the Tribe. The U.S. Army Corps of Engineers approved several of the permits without conducting an environmental review or adequately consulting with the Tribe.

In 2016, the Standing Rock Sioux Tribe became the epicenter of a global climate justice movement. I was the first camper at what became Sacred Stone and Oceti Sakowin camps. These camps became the largest mobilization of Indigenous nations in over 140 years.

After several months of peaceful demonstrations across the globe, President Obama listened to the demands of the Standing Rock Sioux Tribe. He rejected the final permit, and the U.S. Army Corps of Engineers announced they would conduct a full environmental review, which would focus on the Tribe’s treaty rights.

The permit was rejected until Donald Trump reversed course just hours after taking office and granted the final permit.

Now, Biden has the chance to remedy his predecessor's harmful, unjust decision.

By shutting down this pipeline, Biden can put an end to the long-standing tradition of the US government steamrolling the interests of sovereign tribes and Indigenous communities in favor of corporations’ interests.
