Troubling new data from the FBI shows that gun sales continued to surge to
unprecedented levels last month. This surge in gun sales is overwhelming
our background check system and, due to a gap in our federal laws known as
the Charleston loophole, is likely leading to thousands of guns^1 being
sold to people who can’t pass a background check and can't legally own a
gun.
The Charleston loophole allows gun dealers to complete gun sales after
three business days even if a background check is still ongoing. Without
swift changes in our country's gun safety policy requiring a completed
background check on every gun sale, our already devastating gun violence
crisis could get even deadlier.
