Reps. Swalwell (who we’re about to file a lawsuit about his connection to a Chinese spy), Raskin, Lieu, and the other radical Left impeachment managers have just filed their Impeachment Brief. It’s utter nonsense and ignores constitutional mandates.
At the ACLJ, we’re preparing to submit our own legal analysis to the U.S. Senate on the unconstitutionality of this impeachment.
- The Chief Justice of the United States isn’t serving as the presiding officer – something the Constitution requires: “When the President of the United States is tried, the Chief Justice shall preside.”
- The Constitution provides for the impeachment of “The President,” not a former President.
- You can’t impeach a private citizen – legally, that’s an unconstitutional bill of attainder.
It’s clear this is an unconstitutional impeachment trial. We MUST defend the Constitution. It’s what we’ve been doing at the ACLJ for decades.
