Plans are underway to limit your ability to challenge injustice.

For years, ordinary people have been able to enforce their rights and challenge
governments and public bodies when they get it wrong.

But the Government is looking at ways to weaken ‘judicial review’, the legal
process that enables you to hold the powerful to account in court. And it is
also “reviewing” the Human Rights Act which protects our rights in law.

Being able to stand up to power is at the heart of our democracy and is
essential to creating a fair and just society.

Magda and Ian

Magda’s six-year-old son, Ian, loves his school and has lots of friends – but
without judicial review, he might not be getting any schooling at all.

Ian has autism. His mum knew he would need extra help to transition from nursery
to school – but the school didn’t have the resources to meet his needs.

Ian couldn’t cope with the demands of the classroom without support. He found
school overwhelming and his autistic behaviours escalated. The head teacher then
restricted him to only attending for an hour a day.

With Ian’s whole education at risk, Magda started legal action against the local
education authority (LEA). After that, Ian was given the extra support he needs
from the LEA and is now happy and settled at school.

Joe Ousalice

After serving for 18 years, Joe was discharged from the Navy in 1993 and had his
medals stripped from him because of his sexual orientation.

Supported by Liberty, Joe started legal action against the Ministry of Defence
in 2019 for violating his human rights. Shortly afterwards, in a historic
victory, the MoD returned Joe’s medals, formally apologised, and promised to
introduce a policy to reinstate medals to all LGBT veterans who were dismissed
in similar circumstances.

No one should be above the law

We all want to live in an equal, just and fair society. Right now you can stand
up to power like Magda, Ian and Joe. This must not be taken from us.
