We are almost three weeks into the General Assembly session, and many pro-equality bills are quickly advancing thanks to your engagement and support! Bills that have already passed in the House of Delegates are now being assigned to their Senate committees, and we saw many of our key issues in the Senate move forward and prepare for readings on the Floor.

SB 1138, introduced by Senator Mamie Locke and Senator Jennifer McClellan, would modernize laws that currently criminalize people living with HIV. This week it reported from the Judiciary Committee 7-5 with two abstentions.

Delegate Mark Levine's HB 1932, which would repeal the “conscience clause” for child placing agencies, reported from the Health, Welfare and Institutions committee with amendments 13-9.

SB 1321, introduced by Senator Jennifer Boysko, passed off of the Senate Floor with a 24-13 vote. This bill would allow second parent adoption, which would greatly benefit LGBTQ families.

Additionally, HB 1864 introduced by Delegate Marcia Price passed in the House of Delegates 55-44. HB 1864 looks to expand the Virginia Human Rights Act to any person who employs one or more domestic workers. A similar bill introduced by Senator Jennifer McClellan, SB 1310, reported out from the Commerce and Labor committee with a substitution 12-3 and now has been re-referred to the Finance and Appropriations committee.

Senator McClellan’s SB 1360 reported out from the General Laws and Technology committee with a substitution 10-1, with three abstentions. It has now been re-referred to the Finance and Appropriations committee. Delegate Vivian Watts’ companion bill (HB 2155) was recommended for reporting from the Professions/Occupations and Administrative Process subcommittee and then reported from the General Laws committee with a substitution 13-9. These bills define sexual and workplace harassment, including sexual orientation and gender identity, and extends the length of ability to file after the incident.

SB 1366, introduced by Senator George Barker, has been engrossed by the Senate with a substitution and is preparing for reading on the Senate Floor. Through this bill, the Department for Aging and Rehabilitative Services would be required to include LGBTQ older Virginians in the category of greatest social need as defined in the Older Americans Act.

Bagels & Bills

Are you hungry for LGBTQ equality? Join us for our Bagels & Bills series every Monday morning during the General Assembly session to satisfy your appetite. 

Thanks to your support last week, the HIV decriminalization bill and the conscience clause repeal both moved forward - let’s keep up the momentum! This coming week, Deirdre Johnson and Cedric Pulliam (co-founders of Ending Criminalization of HIV and Over-incarceration in VA) will join us to discuss what comes next.

We are also excited to welcome several special guests to discuss banning the LGBTQ panic defense, including bill sponsor Delegate Danica Roem, Judy Shepard from the Matthew Shepard Foundation, Wes Bizzell from the National LGBT Bar Association, and Jonathan Yglesias from the VA Sexual & Domestic Violence Action Alliance.

Bills advancing LGBTQ equality are quickly moving through the General Assembly, and many are due for critical votes this week in the House of Delegates and Virginia Senate.

Make sure your lawmakers hear from you that LGBTQ Virginians must be a priority at the 2021 General Assembly.

Transgender Student Protections

Last call to take a public stand with trans youth!

Thousands of Virginians have stood in support of protections for trans and non-binary students during the VA Department of Education's public comment period, which ends Wednesday, Feburary 3. However, many harmful, anti-trans messages continue to roll in. 

We can fight this together by standing up loudly and proudly for trans and non-binary youth’s safety in schools. Submit a public comment in support right now!
