45 Republican senators recently voted to declare that holding an impeachment trial for Donald Trump now that he's out of office is unconstitutional.
 
The motion, introduced by Rand Paul, failed in the Senate, but it provides a glimpse into what we can expect on February 8. The irony? Mitch McConnell chose not to start the impeachment trial before Trump left office and yet now claims it's too late to impeach a former president.
 
Legal scholars from both sides of the aisle disagree, especially given that there is precedent for impeachment trials after officials have left service. But Republicans are already taking back their words of accountability and hoping they can do one more favor for Trump.
 
As MSNBC's Steve Benen writes, that might be because the “political momentum for accountability...has largely evaporated.”
