- The Constitution provides for the impeachment of “The President,” not a former President.
- You can’t impeach a private citizen – in the law we’d call that an unconstitutional bill of attainder.
- The Chief Justice of the Supreme Court isn’t serving as the presiding officer – something the Constitution requires: “When the President of the United States is tried, the Chief Justice shall preside.”
This is clearly an unconstitutional impeachment trial. It’s a political harassment trial of President Trump.
