We’re Still Texas

What to Know: Following the special Senate elections in Georgia on Tuesday, it appears that the Democrats are moving closer to control of the Senate. We may all know more later today.

The TPPF Take: Fear not! For it’s a brand new day in Texas, the greatest state in the greatest country in the world. And Texas is uniquely positioned to lead on conservative issues, even (or especially) with Congress fully in control of the Democratic Party.

“We’ve always said as Texas goes, so goes America, and that’s never been more true,” says TPPF’s Kevin Roberts. “The next phase of the conservative movement will likely focus on litigation—engaging the new conservative majority on the U.S. Supreme Court (President Trump’s legacy) to beat back government overreach and be a check on an activist Biden administration. TPPF’s Center for the American Future, and our attorneys led by Robert Henneke, are ready for this challenge.”

Property Rights and Wrongs

What to Know: According to the legal website Law360, a case brought by TPPF on behalf of an East Texas property owner regarding the CDC’s ban on evictions is a key real estate case to watch.

The TPPF Take: The lawsuit points out that the CDC rule is a massive overreach, and that if halting evictions could truly curb the spread of COVID-19—and there’s no evidence it could—it’s still an abuse of power.

“The CDC order violates Lauren’s constitutional rights by forcing her to keep an unwanted person on her private property and blocks her from exercising her legal remedies under state law,” says TPPF’s Robert Henneke. “The federal government cannot do this. Period.”

Rose Bowl

What to Know: The Rose Bowl was held on New Year’s Day—but not in its traditional location. It was moved from California to Texas.

The TPPF Take: This is only the second time “the Granddaddy” of bowl games (so named because it is the oldest continuous contest) won’t be played in California.

“The cause of the Rose Bowl’s move east is California lawmakers, from Gov. Gavin Newsom to city officials, putting the state into another, tougher lockdown—despite a growing body of evidence that such lockdowns do little to slow the virus and save lives,” says TPPF’s Chuck DeVore. “What the lockdowns do instead is destroy businesses, especially family-owned ventures, harm mental health and lead to an increase in suicide and overdoses.”
