In 2020, Brady Legal was unstoppable in the face of a hostile Trump-Pence administration and an increasingly conservative judiciary.
With your support, we have had landmark victories that will affect the gun violence prevention movement for years to come. We are holding federally licensed gun dealers accountable, addressing gun violence as a racial justice issue, and giving victims of gun violence justice in court. Although 2020 may be a number we all want to forget, there are some important numbers, and victories, that we should surely remember and celebrate:
This year, Brady Legal successfully won or settled three pivotal cases. We filed 11 lawsuits in 7 states around the country aimed at reforming the gun industry. Brady was involved in litigating 41 cases as counsel or amicus in federal and state courts across the country.
We won a major victory this fall when the Superior Court of Pennsylvania agreed with Brady arguments and held that the federal gun industry protection law, the Protection of Lawful Commerce in Arms Act (PLCAA), is unconstitutional in its entirety. We made a huge step toward bringing justice to the family of 13-year old J.R. Gustafson, who was shot and killed by another boy who thought the gun was unloaded after the ammunition magazine was removed. The ruling is a landmark victory in the effort to hold the gun industry accountable for its role in driving America’s gun violence epidemic.
Just this month, we introduced the nation’s first civil lawsuits on behalf of survivors and victims of gun violence against the ghost gun industry. We’re representing survivors and families of people killed in a 2017 rampage shooting in which the gunman — who was legally barred from owning guns — evaded a background check by obtaining an unregulated and untraceable “ghost gun.” We’re alleging that the ghost gun industry exploits dangerous online loopholes that enable prohibited purchasers to acquire weapons without a Brady Background Check.
2021 has an even more conservative Supreme Court and more legal battles for our team. But, with your support, we will continue to fight hard— and win.
