Biden’s New EPA Chief Should Heed the Lessons from His Home State

President-elect Joe Biden has nominated Michael Regan to lead the EPA. Regan worked at the Environmental Protection Agency (EPA) for years, and has been North Carolina’s environmental chief since 2018. As North Carolina’s top environmentalist, Regan has opposed constructing natural gas infrastructure, claiming North Carolina’s clean energy future is not dependent on adding more natural gas infrastructure we should invest in clean, renewable energy sources and the economic benefits of energy innovation.

The Right Diversity Approach

Equality of opportunity could achieve most diversity goals, if the pools of candidates representing various identity groups had comparable qualifications. They seldom do, however, which has led to many forms of affirmative action. Such programs are typically zero-sum because they involve allocating a scarce resource, and in practice they typically end up as exercises in political power and greasing the squeakiest wheels.

Chalfant didn’t tell Gov. Gavin Newsom “no” directly. The state’s ban on outdoor dining wasn’t at issue in this case. But his ruling opens up the entire lockdown framework to legal challenges. If Los Angeles County has to support its ban with data, then every other restriction needs to be held to the same standard.
