** BREAKING: ATF Withdraws Notice & Request For Comment On Pistol Braces
------------------------------------------------------------
Shortly after ASA sent out our Action Alert last night, ATF posted a letter ([link removed][UNIQID]) to their website withdrawing ATF Docket # 2020R-10 from the Federal Register, ending their request for comment just five days after posting it. The notice resulted in massive public outcry to the tune of over 67,000 comments ([link removed][UNIQID]) - including nearly 20,000 comments in the last 24 hours. 89 members of Congress also sent aletter ([link removed][UNIQID]) to the Attorney General and the Acting ATF Director requesting that they reconsider their position.

Background:
On December 18^th, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) posted Objective Factors for Classifying Weapons with “Stabilizing Braces” ([link removed][UNIQID]) for public comment on the Federal Register. The notice proposed to list "objective criteria" for determining the classification of pistol-type firearms equipped with stabilizing braces - an accessory commonly referred to as a pistol brace that is used by millions of law-abiding gun owners. If implemented as drafted, many, if not all, of the millions of pistol-type firearms would have been required to be registered as short-barreled rifles under the NFA.

At its core, ATF’s proposal sought to cement the agency’s bureaucratic authority to reinterpret and change statute through regulatory fiat. Their proposed criteria were anything but objective; rather, their language emphasized the inherently subjective nature of their recommended standards.

If enacted, this notice would have put millions of law-abiding gun owners at risk of unknowingly becoming a felon.
