County Common Pleas Court Judge Chris Brown said to allow the House
Bill 6 nuclear bailout fee "would be to allow certain parties to prevail. It
would give the OK that bribery is allowed in the state of Ohio and
that any ill-gotten gains can be received. All you’ve got to do is
find the right legislator, find the right speaker of the
House."
Judge Brown ordered the Public Utilities
Commission of Ohio and the state treasurer to refrain from collecting
any fees under HB 6 and prohibited Energy Harbor from
attempting to collect those fees, set to begin in
January. The
bailout's freeze was sought by Attorney General Dave Yost’s
office and the cities of Columbus and
Cincinnati.
It is unclear if that order may be appealed.
The lame duck session continues tomorrow
It's hard to believe that HB6 remains intact after five
months of inaction from House and Senate leadership since the FBI
arrested Larry Householder. Legislators struggled to find the needed
votes to pass anything on the matter last week.
