The Supreme Court has denied the request for emergency relief—but there’s an encouraging silver lining that gives us a pathway back to the High Court if the Kentucky Governor doesn’t mend his ways when school resumes next year.

And we’re especially optimistic about our chances for victory at the Supreme Court if Governor Beshear does indeed renew this discriminatory order in 2021, because Justices Alito and Gorsuch have signaled that they are already on board. To quote Justice Gorsuch’s dissent:
“This Court has made clear it will no longer tolerate departures from the Constitution. That was the proper course in past cases, as I believe it is here. I would not leave in place yet another potentially unconstitutional decree, even for the next few weeks.”
