On December 4, 2020, in a major victory for the immigrants’ rights movement and DACA recipients everywhere, a New York federal court ordered the Department of Homeland Security (DHS) to restore DACA to its original form! If you are eligible for DACA, here’s what this means for you:
If you have never had DACA and are eligible, you can apply for the first time.
Advance Parole is back in its original form
Anyone who received a 1-year renewal of their DACA will automatically have their protections extended to two years
Renewals continue to be accepted
While this ruling is hugely encouraging, we also know there is an additional pending lawsuit that could impact applications and renewals. So if your DACA expires in 2020, or if you have never had DACA, we encourage you to find a renewal clinic, accredited representative, or immigration attorney and apply or renew as soon as possible.

So where does the future of DACA stand? In addition to the pending lawsuit, the Trump Administration has indicated they may seek a stay on this ruling, halting the acceptance of new applications. That’s why those who are considering applying, and are eligible, should do so as soon as possible.
However, a new presidential administration will soon take office. In the next four years and beyond, we have the opportunity to transform our broken immigration system and create processes that are just, equitable, and humane for all. We will continue to advocate for a pathway to citizenship, not just for DACA recipients but for all 11 million undocumented immigrants who call this country home.
