Americans deserve bankruptcy laws that protect them. Here’s how this act will do just that:
- Makes the process easier and less expensive by replacing the two consumer bankruptcy chapters with a single system to streamline the process and reduce fees
- Ensuring filers can care for themselves and their families during the process by helping renters avoid eviction, making student loan debt dischargeable, and allowing people to protect their homes and cars during the process
- Addressing racial and gender disparities in the system by preventing people from obtaining relief for debts arising from civil rights violations and exempting sources of income and assets traceable to alimony, child support, the child tax credit, and the Earned Income Tax Credit
- Closing loopholes like the “Millionaires Loophole” and the “spendthrift clause loophole” that allow the wealthy to exploit the system
- Cracking down on predatory practices and holding corporate wrongdoers accountable
