City Journal: Set-asides are unconstitutional
COVID-19 has devastated small businesses nationwide, and New York’s entrepreneurs and landlords have been particularly hard hit. In response, Governor Andrew Cuomo has awarded millions of dollars to affected small businesses. But to get these taxpayer-funded loans, it helps to be a minority-owned business. Cuomo’s office announced it will be “focusing on” COVID relief for minority- and women-owned firms.

Justice for a PLF client: Frozen land isn’t navigable water
When Richard Schok decided to relocate and expand his growing North Pole, Alaska, pipe fabricating company, he bought new land next to a junk car dealer, a scrap metal dealer, and a concrete product supply company, not a wetland. Or so he thought.
The Army Corps of Engineers, however, decided that his property, despite being frozen year-round, was a wetland under the Clean Water Act. Years of unsuccessful litigation followed and it looked like Richard’s business plans were iced—permanently.
But earlier this year, the Trump administration adopted a new rule about what land is regulated under the Clean Water Act. Jeffrey McCoy writes that while far from perfect, the new rule does make several improvements and will help small business owners like Richard.
