** The Weak Argument for the Constitutionality of the ACA’s Individual Mandate ([link removed])
------------------------------------------------------------
Yesterday, the Supreme Court started to hear California v. Texas, the latest challenge to the Affordable Care Act (ACA). California's arguments in favor of upholding the individual mandate as a zeroed-out tax are weak. Both liberal and conservative legal commentators agree that there is virtually no chance the Supreme Court will strike down the entire ACA because the individual mandate is severable from the rest of the statute. But this doesn’t mean the case is inconsequential. On the contrary, a ruling that the individual mandate is unconstitutional ([link removed]) will establish all-too-necessary constraints on Congress’s taxing power and may reimpose some crucial federal power limits.

** Media Trumpeting Reelection of 'The Squad' ([link removed])
------------------------------------------------------------
The Story: Teen Vogue, along with other media fawning over the progressive 'Squad,' celebrates the reelection of 'The Squad' and a "burgeoning progressive movement in the House."

In Short: There seems to be a tale of two women’s empowerment movements. At least in terms of coverage and praise. This is what we call "Progressive Privilege ([link removed]) ." The women who really dominated congressional elections, making history with an unprecedented wave of victories in the House, were Republican women. If there’s anything this election has taught us, it’s that we need to Champion Women, especially those women who dare to think and speak for themselves or hold conservative beliefs.

** California V. Texas (The Affordable Care Act Case) ([link removed])
------------------------------------------------------------
Democrats opposed the confirmation of Justice Amy Coney Barrett on the grounds that she will be a vote to strike down the Affordable Care Act—including its protections for those with pre-existing conditions—in a case argued Tuesday: California v. Texas.

Can you identify which of the following statements about the Affordable Care Act litigation is not true?

A: The most consequential question in California v. Texas is whether the individual mandate can be severed from the rest of the Affordable Care Act.
B: There is near-unanimous agreement among liberal and conservative legal experts that the Supreme Court will not eliminate the entire Affordable Care Act or protections for Americans with pre-existing conditions.
C: The confirmation of Justice Amy Coney Barrett guarantees that the Supreme Court will dismantle the Affordable Care Act.

** Uber, Lyft Escape AB5 but the Gig Economy Does Not ([link removed])
------------------------------------------------------------
Voters in California approved Proposition 22 by a wide margin last week, a ballot initiative that would exempt Uber, Lyft, and other ride-sharing and delivery providers from having to reclassify their drivers as employees. Prop 22 came in response to Assembly Bill 5 (AB5), a California law that imposed some of the most significant restrictions on independent contractors in American history. While it’s nice that industries with big microphones and deep pockets were able to successfully lobby for carve-outs, the devastating effects of AB5 persist for thousands of independent workers and small-business owners throughout the state. Worse, several states are considering AB5-copycat legislation, and Joe Biden endorsed it ([link removed]) .

** Is the Electoral College “Unfair”? ([link removed])
------------------------------------------------------------
With the 2020 presidential election results still contested, all eyes are on the Electoral College. While the two-century-old system has withstood tumultuous elections seasons and even the Civil War, many are now questioning its legitimacy.

Is it true that the Electoral College is “unfair”?
[link removed]
While anyone can claim that any system is “unfair” for subjective reasons, the Electoral College is designed carefully precisely to be fair to all American voters, so that we all can have a say in choosing the next president.
