The conservative majority on the Supreme Court has once again proved itself to be hostile to voting rights. Even during a pandemic when Americans are voting by mail in record numbers, they’re refusing to allow mail-in ballots postmarked on Election Day, but received a few days later, to be counted in Wisconsin!
Justice Kagan penned a blistering dissent, pushing back on the idea that counting ballots received after Election Day could “flip” the results of the election: “There are no results to ‘flip’ until all valid votes are counted,” she wrote, adding “Nothing could be more ‘suspicio[us]’ or ‘improp[er]’ than refusing to tally votes once the clock strikes 12 on election night.”
Unfortunately, the Supreme Court just got a whole lot more conservative last night with the confirmation of Justice Barrett -- so we can expect the Court to continue being hostile to voting rights well into the future.
