Amy Coney Barrett’s confirmation to the Supreme Court is upon us.
But here’s something to keep in mind: There’s nothing in the Constitution that mandates the Supreme Court have only nine justices. In fact, the Supreme Court has seen its size change seven times over its history -- at some points having as few as five justices or as many as ten.
The bold idea to expand the size of the Supreme Court after a Biden win in November -- allowing him to appoint anywhere from 4 to 6 new justices -- is now being considered by a coalition of progressives. Some are dismissive of the notion, calling it radical, while others hold that it’s Republicans who got us here, and this is the only way to prevent conservatives from commanding a rock-solid 6-3 majority for the next several decades.
