While we have fought to take the next step in the New Deal, creating a guarantee of economic and health justice by expanding Medicare to all Americans, and expanding Social Security to address the retirement income crisis, a shady conservative movement has been building power to try and overturn the New Deal in the courts―and Amy Coney Barrett will be the crown jewel in their plot.
When arch-conservative justices threatened to overturn Social Security in the 1930s, did FDR throw up his hands and say “oh well” while the New Deal went down in flames? No: He met the court’s right-wing threats with a promise to restore democratic legitimacy to the Court by adding members. If Republicans succeed in stealing another Supreme Court seat, Democrats must respond by using their Constitutional powers to add seats and preserve the New Deal!

More than 40 million people have voted in the 2020 election, yet Republicans are planning to ram through another Justice for an impeached president who received 3 million fewer votes than his opponent, and appears likely to lose in a landslide in 12 days.
This is an exercise in pure power for a party that knows it can’t win democratic elections because its undemocratic, plutocrat-friendly policies would be rejected by the populace. Their endgame is declaring Social Security and Medicare unconstitutional, and keeping Republicans in power with an ever-shrinking minority of Americans supporting them.
A 6-3 hard-right Court is an existential crisis for our democracy. The only way we can stop them from repealing the whole 20th century of economic security advancements is by adding Justices and restoring legitimacy to the court!
There’s nothing sacred about 9 Justices. It's not in the Constitution. The original composition of the Supreme Court was six members. In 1866, the Judicial Circuits Act set the number of justices at seven, to match the number of circuit courts that existed. The country has grown to the point that there are now thirteen circuit courts―it’s only right for the Supreme Court to grow as well.
This is critically important.
