Report back on landmark “Hudbay Minerals” lawsuits

On September 17, 2019, there will be a public court hearing in Toronto to determine whether the Mayan Q’eqchi’ plaintiffs from Guatemala can amend their pleadings regarding Skye Resources’ (that amalgamated with Hudbay Minerals in 2008) violent forced evictions in 2007 of their home community, “Lote 8”, during which 11 Mayan Q’eqchi’ women were gang-raped.

Hudbay Minerals is arguing that the plaintiffs should only be able to sue for the gang-rapes committed by their private security guards, not the rapes committed by the Guatemalan military and police. This, notwithstanding the fact that the gang-rapes of the 11 women were committed by roving groups of armed police, military and security guards, during the violent eviction that was requested, authorized and co-planned by Skye Resources. This, notwithstanding the fact that Skye Resources/ Hudbay Minerals made large monetary payments to the Guatemalan police and military to pay for their direct involvement in the planning and execution of the violent forced evictions, alongside Skye/Hudbay’s private security guards.
 
Two of the plaintiffs - Irma Yolanda (a gang-rape victim) and Angelica Choc (widow of Adolfo Ich who was murdered during a separate incident by Hudbay’s security guards) - will travel to Toronto for the hearing.
