During her confirmation hearing a few hours ago, President Trump’s Supreme Court nominee declined to say whether she would recuse herself, if confirmed, from casting a vote in Xavier’s lawsuit defending the entire Affordable Care Act.
Tonight, we are exactly one month away from this lawsuit being heard at the Supreme Court — and Xavier is giving this fight his all.

Today’s Supreme Court confirmation hearing was exactly what we knew it would be: A partisan last-ditch effort to end the Affordable Care Act, undermine reproductive rights, and cement a conservative Court majority for generations.
When Republicans refused to hear President Obama’s SCOTUS nominee, the election was nearly a year away. Today, 10 million Americans have already voted.
In the middle of an election, why are Republicans in such a rush? It’s because they know that my Supreme Court lawsuit to save the Affordable Care Act is being heard one week after Election Day, and they want to do everything they can to try to get one more vote.
No matter what happens in this confirmation process, one thing is certain: We will be at the Supreme Court in just weeks to stop Trump and Republicans from ripping away healthcare from 20 million Americans during this pandemic. Team, as we gear up for this fight can you stand with us?
