On day two of the hearings, Amy Coney Barrett has done nothing to contradict her writings criticizing the Affordable Care Act. She has made no attempt to address President Trump’s commitment to only nominate judges who will overturn the ACA and Roe v. Wade and largely refused to comment on Roe, even claiming it wasn’t settled law. 

Remarkably, Barrett continues to repeatedly claim that her academic writing — which reflects the bulk of her legal experience — in no way speaks to how she would interpret the law. When pressed, she claims her criticism of the opinion upholding the ACA by Chief Justice Roberts was just an “academic critique.”

We know that is not the case.

That “critique” signaled her ability to pass Trump’s litmus test, which propelled her to the top of his shortlist. It is what he and Senate Republicans are relying on when the Supreme Court rules on the constitutionality of the entire law next month.

Barrett also refused to answer questions about whether the President can unilaterally delay the election and, more alarmingly, she evaded answering whether a president should commit to a peaceful transfer of power. These are not academic questions but go to her fitness to sit on the highest court of the land. In fact, a nominee has an obligation to prove their worthiness to meet the highest standards of the bench, not the other way around.

Sen. Lindsey Graham has announced he will hold the first Senate Judiciary Committee markup for Barrett’s nomination on Thursday morning — before the hearings are even complete, showing just how little Senate Republicans care about thoughtfully vetting her nomination.
