The Trump administration last week introduced the most significant changes to the H-1B visa program in three decades, promising to end the practice of replacing U.S. workers with highly skilled immigrants.
A pair of interim final regulations introduced by the Departments of Labor and Homeland Security will significantly increase the wage levels required for H-1B workers, narrow the jobs that qualify for the program, and slash the visa period from three years to one year for some H-1B holders.
While the problems the administration has identified and the interest in protecting U.S. workers from displacement are legitimate ones, a new Migration Policy Institute commentary explains that the approach may cripple the H-1B program -- which, regardless of its flaws, is the primary route through which employment-based immigrants enter the United States.
"There are smart, implementable fixes that can be made to prevent abuses and repoint the H-1B program in ways that would go much further toward advancing U.S. economic and competitiveness interests -- to the benefit of U.S. workers -- than the broad and blunt reforms advanced by the administration," writes Policy Analyst Sarah Pierce.
