Despite multiple members testing positive for COVID-19, the Senate Judiciary Committee will begin hearings for Trump's third Supreme Court nominee, Amy Coney Barrett, on Monday.

Barrett, whose father spent most of his career as an attorney for Shell Oil, would give corporate fossil fuel interests a 6-3 conservative majority on the Supreme Court -- more than enough to kill climate legislation. (And by the way, the Court has just announced they'll consider a case in 2021 that could make it harder to hold fossil fuel companies accountable for climate change.)

Most Americans agree that the next justice should be named by the winner of the 2020 election, which is already underway. It is unconscionable for Republicans to try to ram through a Supreme Court nominee as early ballots are being cast across the country and while multiple members of the committee are testing positive for the coronavirus.

If Trump successfully appoints Amy Coney Barrett to the Supreme Court, Democrats in 2021 must eliminate the filibuster and expand the court. Sign on to show your support.

If confirmed, Amy Coney Barrett will be the fifth justice on the bench -- alongside Justices Alito, Roberts, Gorsuch, and Kavanaugh -- to have been nominated by a president who lost the popular vote. It's a balance that doesn't reflect the will of the people, and now, the fate of the planet quite literally hangs in it.

If Democrats succeed in taking the White House and Senate, they must use every tool at their disposal to ensure that America can effectively mobilize against the climate crisis at the speed and scale that science demands. That means pulling out all the stops -- from eliminating the filibuster to adding more seats to the bench -- to keep the Supreme Court from becoming a tool for blocking climate action.
