To keep us all up-to-date on developments in all six cases, our friends at CBPP and MLRI have created a helpful Public Charge Litigation Tracker.
Public Charge FAQs, Litigation Updates & New Community Resources
Happy Monday! In this week’s newsletter we are sharing answers to your frequently asked questions about the final public charge rule, updates on public charge litigation efforts and some new materials that you can use for your outreach and education efforts.
HAVE QUESTIONS ABOUT THE FINAL PUBLIC CHARGE RULE? WE HAVE SOME ANSWERS.
Does the public charge test apply to renewals of green cards? What immigrants are eligible for public programs in the rule and are also subject to a public charge test? If you have outstanding questions about the final public charge rule, don’t forget to check out PIF’s revised Analysis and FAQs on the final DHS Public Charge Regulation, where we answer these and other key questions.
Not seeing your question in our FAQ? We’ve created two forms for individuals and organizations to fill out with any additional questions. If you’re asking on behalf of your organization, use this link. If you’re asking on behalf of yourself, use this link. Note: PIF cannot answer questions related to specific cases. For legal assistance, we encourage you to use the Immigration Advocates Network legal directory.
KEEPING TRACK OF PUBLIC CHARGE LAWSUITS
As you know, litigation to block implementation of the public charge rule is moving full speed ahead. There are currently 6 complaints filed challenging the rule around the country, and a few more may be filed. Additionally, many of our PIF allies have drafted and joined amicus briefs in support of these efforts. Litigators in all three cases filed in the Northern District of California have asked the court to block DHS’s public charge rule from taking effect before the rule’s October 15 effective date. Preliminary injunction motions have been filed and will be heard on October 2.
To keep us all up-to-date on the developments in all six cases, our friends at The Center on Budget and Policy Priorities (CBPP) and Massachusetts Law Reform Institute (MLRI) have created this helpful Public Charge Litigation Tracker.
