Friend – Despite Justice Ginsburg’s “most fervent wish” that no new Supreme Court justice be confirmed until the next presidential term begins, President Trump has already nominated her successor: Amy Coney Barrett, an opponent of church-state separation.
We are urging the Senate to oppose Barrett’s nomination – and not consider any nominee until the next presidential term begins.
Barrett’s record shows that she will likely undermine church-state separation, which is the foundation of religious freedom for all. She would allow religious freedom to be used as a sword to harm rather than a shield to protect, particularly against women, LGBTQ people, religious minorities, the nonreligious and others.
The separation of church and state is the linchpin of religious freedom and one of the hallmarks of American democracy. The Senate must not confirm a justice who puts that principle at risk.
What’s at stake if Barrett is confirmed:
- The religious freedom of students and families in our public schools
- The right to decide whether you fund someone else’s religion
- The right to make decisions about your own health care
- The right to love whom you choose, free from discrimination

With the presidential election already underway, the American people should decide who succeeds Justice Ruth Bader Ginsburg – a staunch advocate for church-state separation and equality for all. The Senate, President Trump and his extremist allies must not rush through a lifetime appointment to the Supreme Court until the people have spoken.
Pushing through Barrett’s confirmation before the election is an insult to Justice Ginsburg’s legacy and a threat to religious freedom.
