This summer, EDF and our allies saw our winning streak reach a fever pitch when in the span of a single week, three courts issued four decisions in favor of environmental protection:
- First, a federal court of appeals upheld an Obama-era rule that ensures energy storage can compete fairly in wholesale electricity markets.
- Four days later, the same court found that EPA had unlawfully denied a petition from New York State, when it ignored the state’s plea to protect New Yorkers from cross-state air pollution from upwind coal plants and the oil and gas industry.
- Just one day later, another federal court blocked the Trump administration’s attempt to roll back methane waste standards that require oil and gas developers to control methane waste on tribal and public lands.
- And two days after that, a third federal court rejected the administration’s attempt to block California’s coordination with Quebec to cut climate pollution, by claiming it was somehow unconstitutional.
This dizzying week of victory was a long time in the making. Before any lawsuits were even filed, EDF members helped lay the groundwork for success by submitting tens of thousands of comments on the administration’s reckless anti-environmental proposals.
Federal agencies are required by law to consider and address the concerns citizens raise during a formal comment period. The Trump administration’s routine disregard for your input, while infuriating, has only made their countless anti-environmental proposals that much more vulnerable to legal challenge.
And of course, financial contributions to EDF’s Legal Defense Fund throughout 2020 were also key to every environmental victory we secured.

These are just a few of the court battles EDF is currently fighting to protect your right to a clean, healthy environment:
- Opposing roll back of our national Clean Car Standards. This rollback would cause more than 18,000 premature deaths, cost Americans $244 billion at the gas pump, and produce as much climate pollution as running 68 coal plants for five years.
- Stopping EPA from weakening and eliminating key safeguards against methane pollution from the oil and gas industry — even as some major oil and gas companies have argued for the standards to be strengthened.
- Defeating EPA’s July 2019 rule repealing the Clean Power Plan, America’s first and only nationwide limits on carbon pollution from existing power plants, and establishing a do-nothing replacement that would increase pollution at nearly 1 in 5 of the nation’s fossil fuel-fired power plants.
- Forcing EPA to stop unlawfully delaying the implementation of clean air standards aiming to protect us from air pollution from landfills.
- Opposing pending proposals that would restrict EPA from considering vital public health science and undermine EPA’s ability to fully value public health benefits when making decisions about life-saving health and environmental protections.
