Donald Trump and Mitch McConnell have done it. They’ve violated Justice Ginsburg’s dying wish, nominated Amy Coney Barrett, and intend on ramming through her confirmation before the election. Her appointment will tilt the court to the right for the next generation.
If confirmed ahead of the election, Barrett will be allowed to cast a pivotal vote on the future of the ACA. Her record is clear: She thinks Chief Justice Roberts is wrong on allowing the ACA to stand. On November 10th, she’ll have the opportunity to help destroy the ACA – throwing millions of Americans off their health insurance, and allowing insurers to refuse to cover COVID-19 patients, even if they’ve already recovered.
Let’s be honest about our situation here: We just can’t face a national crisis every single time there’s a SCOTUS vacancy. It’s not healthy for our country. It’s undermining the value of judicial precedent, eroding public trust in the institution of the Supreme Court, exhausting activist organizations across the country, and inflaming partisanship in the United States Senate.
No justice should feel the weight of the entire country on their shoulders, nor should the rights of millions of people be decided by chance. Over the last 44 years, Republican presidents have occupied the White House for 24 years and appointed 15 Justices. In that same time period, Democratic presidents have held office for 20 years, and appointed just 4.
That is not reflective of a true democracy. Our nation’s top constitutional questions should be adjudicated by an impartial group of jurists, not a group of people waiting until a president of their choosing is elected so they can be replaced. Our system is in desperate need of reform.
